WATAUGA COUNTY BOARD OF COMMISSIONERS
MONDAY, OCTOBER 6, 2003
 
            The Watauga County Board of Commissioners held a regular meeting on Monday, October 6, 2003, at 9:00 A.M. in the Board Room of the Watauga County Courthouse.

            Chairman Coffey called the meeting to order at 9:00 A.M. welcoming those in attendance.
 
            A moment of silence was observed.
 
APPROVAL OF MINUTES
 
            Chairman Coffey called for additions and/or corrections to the September 4, 2003, special meeting minutes, September 16, 2003, regular meeting minutes and the September 22, 2003, special meeting minutes.
 
            Vice-Chairman Hodges, seconded by Commissioner Honeycutt, moved to approve the September 4, 2003, special meeting minutes, September 16, 2003, regular meeting minutes and the September 22, 2003, special meeting minutes as presented.

APPROVAL OF AGENDA
 
            Chairman Coffey called for additions and/or corrections to the October 6, 2003, agenda.
 
            County Manager Nelson requested to add Watauga County Administrative Building Project Update to the agenda between items 8 & 9 to be presented by Mr. Randy Jones.
 
            Commissioner Blust, seconded by Commissioner Trivette, moved to approve the October 6, 2003, agenda as amended.

BOARD OF EDUCATION MATTERS
 
            A. High School Feasibility Study – Mr. Andy Reese, School Board Chairman, introduced Dr. Bobbie Short, Superintendent, who updated the Board on the High School Feasibility Study. Dr. Short also introduced the consultant, Ms. Sue Robertson, who was hired to determine how to best address the needs for future high school education in Watauga County. As a start to the study, a series of community meetings were scheduled to gather citizen input. Ms. Robertson stated that a Key Communicators committee was to have been established to develop a final recommendation based on the information received during the study process. Dr. Short requested that a Commissioner or an appointee serve as a member of the Key Communicators Committee. Commissioner Honeycutt expressed interest in serving and requested to receive further details after the meeting.
 
            This report was for information only and therefore no Board action was taken.
 
            B. Watauga High School Proposed Renovation Schedule – Mr. David Triplett, Board of Education Maintenance Director, reviewed the proposed schedule of planned renovations for Watauga High School. Mr. Randy Jones, David R. Jones Architecture, project architect, also gave a synopsis of the project.
 
            This report was for information only and therefore no Board action was taken.
 
YMCA PRESENTATION
 
            Mr. Gary Hogue, President of the YMCA of Catawba Valley, presented opportunities for a possible public/private partnership that was used in establishing YMCAs in other counties. 
 
After discussion and by consensus, the Board directed the Manager to continue to explore this possibility by meeting with Mr. Hogue and involving appropriate stakeholders who may be involved with the project.
 
SOIL AND WATER CONSERVATION MATTERS
 
A. NCDENR Stream Restoration Grant Application Request – Mr. Derek Goddard, Soil and Water Conservation District Director, reviewed a grant application that, if awarded, was to provide funds to restore approximately 2,500 feet of the Watauga River. This grant required local match in the form of in-kind services that was to be provided through the Soil and Conservation office. If awarded, grant funds of $116,321.70 with a $58,178.30 in-kind local match totaled $174,500.
 
Commissioner Trivette, seconded by Commissioner Blust, moved to approve the submittal of the grant application contingent upon the approval of the County Manager and Finance Director.

            B. Clean Water Management Trust Fund Grant Approval Request – Mr. Goddard stated that the Soil and Water Conservation District applied for a grant from the Clean Water Management Trust Fund for a variety of water quality improvement projects in Watauga County. Notification was received that $42,500 was available to Watauga County which required $7,500 in local match. The local match was provided by the landowners in the various projects. 
 
Commissioner Honeycutt, seconded by Commissioner Blust, moved to accept the Clean Water Management Trust Fund grant as presented by Mr. Goddard.

FARM SERVICE AGENCY LEASE REQUEST
 
            Mr. Bud Smith of the Farm Service Agency office and Mr. David Tucker of the Natural Resources Conservation Service (USDA agencies) gave updates on the services their agencies provided. Mr. Smith stated that the current lease with Watauga County to provide space in the Agriculture Extension building to the USDA Farm Service Agency expired October 31, 2003. Mr. Smith requested that the lease remain at the current rate of $10 per foot @ 2000 or $20,000 annually. County Manager Nelson stated that he had spoken with Mr. Smith and asked for consideration of an increase to $12.50 per square foot which was more in line, but still less than current office space rentals in Watauga County. Chairman Coffey stated that the Board had two options: 1) to extend the lease; or 2) to extend the lease on a one year time frame with notice given to the FSA that a new rate was to be required effective at renewal time. Mr. Smith stated that it was his understanding that the USDA would not commit to less than a three year lease.
 
The Board tabled further discussion regarding the lease until the October 21, 2003, meeting to allow clarification of the lease requirements of the USDA.
 
SHERIFF’S DEPARTMENT MATTERS
 
A. Vehicle Bid Request – Sheriff Shook reviewed the bids that were received for five Sheriff Department vehicles as follows:

Sheriff Shook recommended that the low bid for three Dodge Intrepids in the amount of $50,658 be accepted from Ilderton Dodge, Chrysler, Jeep, High Point, NC.
 
            The Sheriff recommended accepting the bid of $49,687 from B. Miller Ford, Boone, NC, for two 2004 Ford Explorer 4x4s. This was not the low bid. The low bidder for the 4x4 vehicles was Ilderton Dodge, Chrysler, Jeep, High Point, NC; however, the vehicles had a potential 90-120 day delay in delivery from the date ordered. The Sheriff stated that these vehicles were needed prior to winter weather therefore he recommended the second lowest bidder. 
 
            Commissioner Honeycutt, seconded by Commissioner Blust, made a motion to accept the recommendations of Sheriff Shook and to approve the purchase of the three Dodge Intrepids in the amount of $50,658 from Ilderton Dodge, Chrysler, Jeep, High Point, NC and the two 2004 Ford Explorer 4x4s from B. Miller Ford in the Amount of $49,687.

            B. Jail Census Report – Sheriff Shook reviewed the Jail Census. Twenty-three prisoners have been transferred to the Caldwell County Jail at the rate of $40 per prisoner per day. The County received the same rate for state prisoners who were housed in the local jail prior to transfer to a state facility to begin their sentenced incarceration. The increased census was caused by a variety of factors including increased enforcement efforts by the Sheriff’s office, the Boone Police Department, the Highway Patrol, and Blowing Rock Police Department as well as other law enforcement agencies in the County. The Sheriff stated that he planned to meet with Superior Court Judge James Baker to discuss bonding procedures and other possible options that may be appropriate to remedy the situation until the new jail may be occupied in July of 2005.
 
County Manger Nelson stated that the continued trend of an increased jail census would be a costly issue that needed to be addressed. The County Manager stated that at this time, sufficient data was not available to make long range projections as to the number of prisoners that would need to be transferred throughout the remainder of the fiscal year or to examine potential solutions for funding.

            C. Proposed Inmate Telephone System Contract – Sheriff Shook recommended a contract for inmate pay telephone service as provided by Evercom Systems, Inc. Evercom Systems, Inc., was the current provider of this service and was proposing a new four year contract to supercede the existing contract. The new contract included a service that enabled the monitoring, recording, and logging of each call made from within the detention center. The Sheriff stated that many other features were available that could be used for investigative purposes. The new contract reduced payments to Watauga County by approximately $2,000 per year.
 
            Vice-Chairman Hodges, seconded by Commissioner Honeycutt, moved to approve the contract with Evercom Systems, Inc. for inmate pay telephone services contingent upon the County Attorney’s approval.

            D. Retiree Award Request – Sheriff Shook stated that G.S. 20-187.2 allowed governing bodies of a law enforcement agency to award a retiring member his/her service side arm at a price determined by the governing body. The Sheriff stated that Captain Joe Moody was retiring soon and requested that his side arm and badge be awarded to him upon his retirement and that the Board set the price of the side arm at $1.
 
            [Clerk’s Note: This has been the historical practice of the Board.]
 
            Commissioner Trivette, seconded by Commissioner Blust, moved to approve the gun sale for Captain Joe Moody for $1.00 as presented by Sheriff Shook.

            E. Additional Funding Request –          County Manager Nelson stated that at the September 2, 2003, Board meeting, Sheriff Shook presented a request for additional funding in four areas: 1. Comp and holiday time for detectives; 2. Two new positions with vehicles and equipment; 3. An overtime budget; and 4. Reclassification of a position. At that meeting the Board of County Commissioners approved the payment of overtime and holiday pay to the five detectives as requested and also funded one additional deputy position with a vehicle and the needed equipment. The County Manager stated that, since that time, staff met with the Sheriff and reviewed the requests.
 
Overtime Budget
The County Manger stated that at the September 16, 2003, meeting the Sheriff reported that he was optimistic of receiving a grant that would cover the overtime budget for the remainder of the fiscal year and therefore no Board action was required at this time.
 
Reclassification/s
Staff recommended to the Board and the Sheriff that the reclassification/s be considered during budget preparation for the Fiscal Year 2005 budget which was the established time for considering such requests. The Sheriff stated that he was agreeable with this recommendation and therefore no Board action was required at this time.
 
Holiday Pay
The County Manager stated that regarding holiday pay, the current policy, which was established by the Sheriff as Personnel Officer, had been to award all fifty-one Sheriff’s Department employees eight hours of comp time for holiday pay whether they were scheduled to work or not. The County Manger stated that staff recommended paying only those employees in the Sheriff’s Department who were actually working for an additional eight hours due to the holiday. Holiday pay as opposed to comp time was currently used by other County departments whose employees were required to work holidays. The County Manager stated that it was projected that the policy change would add approximately 2,400 man hours annually to the operation of the Sheriff’s Department; however, it would cost approximately $20,000 to change the policy effective November 1st, for the remainder of the current fiscal year. Sheriff Shook stated that he was agreeable with the policy change but preferred it to be effective January 1, 2004.
 
Commissioner Blust, seconded by Commissioner Honeycutt, moved to approve the Sheriff’s Department policy change as recommended effective January 1, 2004, and funded by an appropriation from the fund balance.

Additional Drug Officer
The County Manager stated that $60,000 was tentatively reserved in the contingency fund for enforcement purposes should the draft ordinances on solid waste and junked cars be enacted. Staff had also identified funds in the Sheriff’s Department capital expense budget due to savings on car purchases in the amount of $10,000. If the Board chose enforcement of the ordinances through the Sheriff’s Department, the $70,000 identified would fund an enforcement officer and a vehicle for approximately six months and leave sufficient funds to hire an additional drug detective and vehicle. If the ordinances were adopted and a grace period was established the officers would not be needed until approximately January 2004. No action was required at this time.
 
By consensus, the Board tabled discussion of the additional officers until a future meeting.

            Chairman Coffey called for a brief recess during which time Commissioner Blust left the meeting due to illness.
 
WATAUGACOUNTY ADMINISTRATIVE BUILDING PROJECT UPDATE
 
            Mr. Randy Jones presented site plans for the Watauga County Administration Building (Heilig-Meyers Warehouse) and updated the cost estimates for the project with a preliminary probable cost of $1,114,223.00 and potential alternates of $29,222.00 for a total of $1,143,445.00.
 
            Commissioner Honeycutt, seconded by Vice-Chairman Hodges, moved to approve the site plan as presented.

            C. Surplus Property Transfer Request – Ms. Isaacs stated that Oasis, Inc. provided services to families suffering from domestic violence. Ms. Isaacs stated that they rehabilitate cell phones for use by clients in their time of need. Ms. Isaacs requested the transfer of six serviceable surplus cell phones owned by the County to Oasis, Inc. The transfer request was appropriate under the public expenditure doctrine in that Oasis, Inc. provided a public service that was funded in part by County funds.
 
            Commissioner Honeycutt, seconded by Vice-Chairman Hodges, moved to approve the transfer of the six cell phones to Oasis, Inc. as requested by Ms. Isaacs.

PLANNING AND INSPECTION MATTERS
 
A.        Request for Additions to State Maintained Secondary Road System – Planning and Inspections Director, Mr. Joe Furman, stated that property owners of Leslie Lane, Julia Pearson Lane, and Forest Park Drive had duly petitioned the County and requested that these roads be included as additions to the State Maintained Secondary Road System. Mr. Furman stated that all three were repeat requests of which the Board had previously approved.
 
            Commissioner Trivette, seconded by Commissioner Honeycutt, made a motion to adopt a resolution to request the North Carolina Division of Highways include Leslie Lane, Julia Pearson Lane, and Forest Park Drive as additions to the State Maintained Secondary Road System.

B.         NCDOT Transportation Improvement Program Discussion – Mr. Furman stated The NCDOT had begun the process of developing the County’s 2006-2012 Transportation Improvement Plan (TIP). Mr. Furman stated that a public input meeting was scheduled for 2:00 p.m. on Wednesday, October 15, 2003, in Hudson to solicit public comment and priorities for the TIP. Mr. Furman stated that he would represent the Board at the meeting and reviewed the draft TIP priorities of the Boone Area Chamber of Commerce.
 
Commissioner Honeycutt, seconded by Commissioner Trivette, moved to endorse the Boone Area Chamber of Commerce’s draft TIP priorities as presented by Mr. Furman.

BROOKSHIREPARK PROJECT UPDATE
 
            Assistant County Manager Geouque reviewed the projected costs of the Brookshire Road park project which had been value engineered to $917,485. To date $828,645 was designated for the project with an additional $175,000 available in the current year’s capital budget as designated for future park projects. Approximately $90,000 was needed to be allocated from the capital reserve to complete the project. Several components of the park would be bid as reductive alternates to assure that bids came in at or below budget. Mr. Michael Trew of Municipal Engineering reviewed the park progress to date including the tentative plan and working budget of $917,485.
 
            Vice-Chairman Hodges, seconded by commissioner Honeycutt, approved the park plan and working budget of $917,485.

DEFERRED COMPENSATION PROGRAM REQUEST
 
            Assistant County Manager Geouque stated that recent legislation allowed loans to be made to employees from their individual 457 retirement accounts. The change was made to be consistent with the loan benefits that were available in the 401K retirement benefits that some County employees participate. 
 
Commissioner Honeycutt, seconded by Vice-Chairman Hodges, moved to approve participation in this benefit by adopting the participant loan administration procedures and the deferred compensation plan for public employees contingent upon review of the County Attorney.

COURTHOUSE ADDITION/HOLDING CELL PLAN
 
            County Manager Nelson discussed plans regarding Phase II of the Law Enforcement Center relocation. The County Manger stated that holding cells could be constructed at the rear of the courthouse or an addition including holding cells could be constructed in the approximate size of 4,700 square feet or 6,000 square feet.
 
            Vice-Chairman Hodges, seconded by Commissioner Trivette, moved to approve an approximate 6,000 square foot addition, including holding cells, bathrooms, elevator, and office space to the rear of the courthouse with a working budget of $1,060,000 therefore allowing the process of architect selection to begin.

MISCELLANEOUS ADMINISTRATIVE MATTERS
 
            A.        Boards and Commissions – County Manager Nelson gave the first reading of a recommendation from the Boone Town Council to replace an ETJ member of the Boone Board of Adjustment. Lee Stroupe was recommended by the Town Council to fill the unexpired term through June 30, 2004.
 
            Board action was not required as this was the first reading of the recommendation.
 
            B.         Announcements – County Manager Nelson announced that a Joint meeting of the Board of Commissioners and Caldwell Community College and Technical Institute was scheduled for Thursday, October 9, 2003, at 6:00 P.M. at the White Oak Campus.
 
The County Manager stated that a public comment meeting was scheduled for 2:00 p.m. on Wednesday, October 15, 2003, in Hudson to solicit public comment and priorities for the NCDOT Transportation Improvement Program.
 
            Chairman Coffey shared a packet of information with the Board entitled “The State Budget Perspective” that he received as district representative to the North Carolina Association of County Commissioners.
